What is copyright?

A copyright is a kind of intellectual property that protects the authentic work of a creator’s creative and literary works, such as educational, musical, artistic, etc. It is a legal term that provides the owner with the lawful right to duplicate, adapt, display, or perform their work for a limited amount of time. Copyright protects the original presentation of the work but not the idea of it.

The moment a piece of work is produced, copyright exists. Getting it registered is the first step to ensuring its safety. It grants the legal right to the creators to protect their authentic work from being stolen or duplicated by providing legal ownership and creating a record with the government of that specific piece of work.

Who can own a copyright registration? 

Copyright is mainly owned by the person who has created the works of presentation, once you create an authentic work, you become a copyright owner. However, there are some exceptions, people who can own a copyright include

    > The originator or creator of the content is qualified for copyright registration

    > A person who claims to have acquired ownership rights from the creator of the authentic work.

    > An agent who has been officially authorized to act on behalf of the creator. 

The creator can make money by selling copies or creating licensed copies of their work, meaning that no one else now has the legal rights to sell copies of this work.

What kind of work requires Copyright Registration?

Copyright registration gives the owner the legal right to use their work, which is fixed in a tangible medium of expression, with some exceptions. When an original piece of work is created, the author immediately owns the copyright to that work. Many types of works are qualified for copyright protection. Some examples are below:

Artistic work

Artistic works include a variety of arts, such as paintings, Sculptures, drawings, Logos, Calligraphies, Architectural Works, and other artistry works.

Cinematographic work

Cinematographic work includes a range of audiovisual works such as TV shows, vlogs, films, documentaries, etc

Literary works

Literary works mostly consist of written works such as books, Lectures musical compositions, Journals, articles, Software programs, and compilation of data, etc.

Recorded works

Recorded works include verbal, or recorded works, like musical, and sound recordings, etc

Using copyright-protected work without infringing:

Copyright infringement is when the use or production of copyright-protected material occurs without the permission of the copyright owner and a third party is breathing those rights. Sometimes, it is possible to use a copyright-registered and protective work without even infringing the creator’s copyright. Your content can be removed and finished in response to a claim of copyright infringement, even if you:

  • Have given credit to the creator or the copyright owner.
  • Refrained from destroying the infringing content.
  • Charged for a duplicate of the content.
  • Have noticed similar content as your work that appears on the internet.
  • Bought the content in some way like a soft or hard copy of the work.
  • Have recorded the content yourself from a cinema or the radio or TV
  • Copied the content from another place such as a picture, textbook, movie poster, etc.

Our procedure for copyright registration in Pakistan

The author who is interested in copyright registration of her work is required to write an application in the approved structure along with the recommended cash amount to the Registrar to get some entering points of interest for their work in the Register of Copyrights. The procedure is as follows:

Applying for an application

The person applying for enlistment will also send a copy of the application to other individuals who are inspired or influenced by the copyright of their work. All applications for enlistment should be united by a Statement of Particulars in triplicate. An extra Statement of further Particulars in triplicate is necessary to be submitted to enlist artistic, musical, dramatic, and literary works. At least 2 copies of the authentic work need to be copyrighted.

Examination

For the work to be copyrighted, expert administrations are engaged, and a vowed statement from those experts will be submitted along with the application, expressing that she doesn’t have any license or guarantee concerning the work to be copyrighted. The enlistment charge will be paid by a demand draft made by the director general of the intellectual property organization. To get the aesthetic work enlistment, the author will put a notice in the paper and submit two copies of this advertisement/flyer to the recorder copyrights

Registration

The Registrar shall enter the particulars of the work in the Register of Copyrights on the receipt of the application and issue a certificate of registration to the applicant unless, for some reason, he considers that such an entry should not be made in respect of the work. A certificate of copyright registration of the work will be clear evidence that copyrights exist in the work and that the person portrayed in the certificate is the owner of the copyright.

Copyright protection

In Pakistan, copyright protection is governed by the Copyright Ordinance, of 1962 (“the Ordinance”) which is based on the English Act of 1914. The act of copying work that is authorized under copyright protection, either directly or indirectly, with the aid of a device or machine is an infringement of the work’s copyright. Strict lawful action can be taken by the creator in this situation.
