Who can be the owner of the design?

If this engineer, architect, artist, or designer is an independent individual, the rights to the design will stay with this individual, even if the developer pays for the design.

You should still note that, in some events, it is possible to use a design that is already copyright-protected and registered without infringing the original creator’s rights and your content can be removed in response to a declaration of infringement, even if you have:

  • Abstained from monetizing the infringed content.
  • Even if you charged for a copy of the content.
  • Noticed similar content appearing on the internet or social media.

APPLICATION

An application form, called Form 15 is given by the Patent Office. You must fill this form with your name, contact details, the structure of your design, the patterns, and additional photos of your design(s). You may also be required to document or have the choice of recording, a Statement of Novelty or a written report for the respective design. The details should be of the design and not the item to which it is applied. It must be straightforward and acceptable in separating your design from any previous designs.
